Terms of Service

1. Acceptance and eligibility

These Terms of Service ("Terms") are a legal agreement between you and Pixora ("Pixora," "we," "us," or "our") governing your access to and use of the Pixora mobile application and related services (the "Service"). By creating an account, selecting the in-app acceptance control, or using the Service, you agree to these Terms and acknowledge our Privacy Policy.

If you do not agree, do not use the Service. You must be at least 13 years old and meet any higher minimum age required in your country. If you are not old enough to enter into this agreement independently, your parent or legal guardian must review and agree to these Terms on your behalf.

2. Accounts and account security

You must provide accurate account information, keep it reasonably current, and protect your password, device, and sign-in session. You may not share access to an account in a way that compromises its security, sell or transfer an account without our written permission, or use another person's account without authorization.

You are responsible for activity performed through your account to the extent permitted by law. Notify us promptly if you suspect unauthorized access. We may require reasonable verification before helping recover an account or responding to a privacy or deletion request.

Your account identifier and authentication credentials are used to associate content, conversations, social activity, purchases, and Lens with the correct account. Signing out or uninstalling the app does not itself delete the account.

3. The Pixora Service

Pixora is a photography community that lets users create profiles, publish photos and videos, enter optional captions, tags, and location descriptions, join challenges, vote, comment, follow accounts, save content, send gifts, and communicate through text, image, and voice messages.

Features, ranking, discovery, limits, and availability may change over time. We may add, modify, suspend, or discontinue parts of the Service when reasonably necessary for operations, safety, legal compliance, or product development. We do not guarantee that any particular content, challenge, account, message, feature, or virtual-item balance will remain available indefinitely.

Any optional location field is text entered by the user. Pixora does not verify that a stated location is accurate. Audience and location-visibility controls determine intended visibility inside the Service, but recipients can still capture, save, or redistribute material they can view.

4. Your content and license to Pixora

You retain any ownership rights you have in photos, videos, audio, messages, profile information, captions, comments, challenge entries, feedback, and other material you submit to the Service (collectively, "User Content"). You are responsible for your User Content and must have all rights and permissions needed to submit it.

When you submit User Content, you grant Pixora a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, process, adapt for technical formatting, transmit, display, and distribute that content solely as needed to operate, improve, secure, and promote the Service according to your selected audience and feature context. This license ends when the content is deleted from our active systems, except where continued retention is reasonably necessary for backups, legal obligations, safety, dispute resolution, or content independently retained or reshared by others.

You may choose whether a post is public or limited to an available audience and whether optional location text is visible. Direct messages are intended for their selected participants. These settings do not create a guarantee of confidentiality and cannot control what another user does after receiving or viewing content.

If you send product feedback or suggestions, you allow us to use them without payment or restriction, provided we do not identify you publicly without permission.

5. Community conduct

You agree not to use the Service to:

  • Post, send, solicit, or promote content that is unlawful, exploitative, fraudulent, threatening, or that facilitates serious harm.
  • Harass, bully, stalk, intimidate, or target another person, including through unwanted repeated messages.
  • Share sexual content involving minors, exploit minors, or attempt inappropriate contact with minors.
  • Infringe copyrights, trademarks, privacy, publicity, or other rights, or upload material you do not have permission to use.
  • Impersonate another person or organization, misrepresent affiliation, manipulate identity, or create accounts to evade enforcement.
  • Publish another person's sensitive personal information without authorization.
  • Send spam, scams, malicious code, or deceptive promotions, or manipulate votes, engagement, challenges, gifts, or Lens transactions.
  • Probe, scrape, reverse engineer, disrupt, overload, bypass access controls, or access the Service through unauthorized automated means, except where applicable law expressly permits the activity.
  • Use reports, blocks, appeals, chargebacks, or support channels abusively or dishonestly.

You must comply with applicable law and respect another user's decision to block you or end a conversation.

6. Messaging, safety, and moderation

Pixora provides controls to report content or users, block accounts, hide messages from your own view, and submit appeals or feedback. Blocking can limit future interaction, but it may not erase material already received by another person or remove every historical reference.

We may review reports and available records, preserve relevant information, limit visibility, remove content, restrict features, suspend accounts, or terminate access when we reasonably believe these Terms or applicable law have been violated, or action is needed to protect users or the Service. We may also decline to act when a report lacks sufficient information or does not establish a violation.

Moderation is not guaranteed to be immediate, complete, or error-free. We are not obligated to monitor all User Content or private communications, but we may review information when permitted by law and reasonably necessary to investigate reports, prevent abuse, or maintain the Service. You may use the available appeal channel if you believe an enforcement action was mistaken.

Act on urgent danger directly. Pixora is not an emergency service. If you or someone else is in immediate danger, contact local emergency services or an appropriate local authority.

7. Lens and in-app purchases

"Lens" are consumable virtual items that can be used only within Pixora for eligible in-app features, such as sending virtual gifts. Lens have no cash value, are not legal currency, do not represent stored value or property, and cannot be transferred, sold, or redeemed for money unless applicable law requires otherwise.

Store billing and delivery

Lens purchases are processed by the platform store through which you obtained the app, such as Apple's App Store or Google Play. The store determines available products, localized prices, taxes, payment methods, billing authorization, and transaction approval. Store terms also apply to your purchase.

When a transaction is confirmed, Pixora credits the purchased Lens to the Pixora account signed in at delivery and records the transaction identifier to help prevent duplicate credit. You are responsible for confirming that you are signed in to the intended Pixora account before purchasing.

Consumable and local-account limitations

Lens purchases are consumable. After confirmed delivery, consumable Lens are generally not restorable through the app store's standard restore-purchases function. Pixora's current Lens balance and delivery ledger are stored locally for the signed-in account. A balance may not automatically transfer to another device and may be lost if app data is cleared, the app is removed, the device is replaced, or account data is deleted.

We may correct a Lens balance or reverse virtual items when reasonably necessary to address duplicate delivery, transaction reversal, refund, fraud, error, or misuse. We may place reasonable purchase or usage limits on Lens.

Refunds and billing issues

Except where applicable law requires otherwise, all purchases are final once delivered. Apple or Google controls store refunds and payment disputes. Request a refund through the store that processed the transaction. Approval of a refund is governed by that store's rules, and a refunded or reversed purchase may result in removal of the corresponding Lens, including a negative or restricted balance if the Lens were already spent.

If a store confirms payment but Lens are not delivered, keep the transaction receipt and contact Pixora. Do not send full payment-card details.

8. Account deletion and termination

You may start account deletion from the in-app Settings. When deletion succeeds, Pixora removes owned business records and uploaded files through available service interfaces, clears account-scoped local data, and signs the device out. Deletion is intended to be permanent and can remove User Content, conversations, social relationships, Lens, and other account data without recovery.

The current hosted authentication interface does not provide Pixora with a portable endpoint to physically delete its internal authentication identity row. After the Pixora account index and business data are deleted, that provider row may remain but is no longer used as an active Pixora profile. We may suspend or terminate access, remove content, or limit features if you materially or repeatedly violate these Terms, create risk or legal exposure, fail to pay an amount lawfully owed, or if we discontinue the Service. Where appropriate and legally required, we will provide notice or an opportunity to appeal.

Provisions that by their nature should survive termination will survive, including ownership, licenses already needed for retained copies, purchase limitations, disclaimers, limits of liability, indemnity, and dispute provisions.

9. Pixora intellectual property

The Service, including its software, interface, visual design, text supplied by Pixora, trademarks, logos, and other materials excluding User Content, is owned by Pixora or its licensors and is protected by applicable intellectual-property laws.

Subject to these Terms, Pixora grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the app for its intended purpose. No other rights are granted. You may not copy, sell, license, distribute, create derivative works from, or exploit the Service except as expressly allowed by these Terms or applicable law.

10. Third-party services

The Service relies on third parties, including hosting and authentication infrastructure, network providers, device operating systems, and app stores. Third-party terms and privacy policies may govern your use of those services. Pixora does not control third-party systems and is not responsible for their independent acts, content, availability, payment decisions, or policies.

Links or references to third-party content do not imply endorsement. Use external services at your own discretion and review their terms.

11. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available." Pixora disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will always be secure, uninterrupted, error-free, or available; that User Content will be accurate or appropriate; or that content, messages, purchases, Lens, or local data will never be lost.

User Content and interactions are created by users. Pixora does not endorse them and is not responsible for relying on them. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

12. Limitation of liability

To the maximum extent permitted by law, Pixora and its affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities arising from or related to the Service, even if advised that such damage is possible.

To the maximum extent permitted by law, Pixora's total liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid through the Service during the 12 months before the event giving rise to the claim or (b) USD 100.

These limitations do not apply to liability that cannot be excluded or limited under applicable law, including where applicable liability for fraud, willful misconduct, gross negligence, death, or personal injury caused by negligence. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Pixora and its affiliates, officers, employees, and service providers from claims, liabilities, damages, losses, and reasonable legal costs arising from your User Content, your misuse of the Service, your violation of these Terms, or your infringement of another person's rights. This obligation does not apply to the extent a claim results from Pixora's own unlawful conduct, negligence, or breach of these Terms.

14. Governing law and disputes

These Terms are governed by the laws applicable where Pixora's responsible operating entity is established, without regard to conflict-of-law rules, except that mandatory consumer protections and rights available in your place of residence continue to apply.

Before filing a formal claim, you and Pixora agree to make a reasonable good-faith effort to resolve the issue informally by written notice, unless urgent relief is needed or applicable law permits you to proceed directly. Any dispute that cannot be resolved informally may be brought in a court with lawful jurisdiction. These Terms do not require arbitration and do not prevent you from using an eligible consumer-protection or small-claims process.

If a provision of these Terms is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; Pixora may assign them as part of a reorganization, financing, merger, acquisition, or transfer of the Service, subject to applicable law.

15. Changes to these Terms

We may update these Terms to reflect changes to the Service, law, safety needs, or our business practices. We will update the date above and provide additional notice when required. If a material change requires renewed consent, we will ask you to accept it before continued use. Otherwise, continued use after updated Terms take effect means you agree to them.
